Welcome to WallBreaker. These Terms of Service ("Terms") govern your access to and use of the WallBreaker website, platform, applications, features, functionality, and content (collectively, the "Service").
The Service is operated by SUMERUAI LLC, with an address at 1501 86th Ave NE, Clyde Hill, WA 98004-3338, United States ("WallBreaker," "we," "us," or "our").
By accessing or using the Service, creating an account, or otherwise interacting with WallBreaker, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you must not use the Service.
1. Important Information About WallBreaker
WallBreaker provides AI-powered companion experiences that allow you to create, discover, customize, and interact with AI Characters.
Although Characters may communicate with you in a human-like manner and may appear to express personalities, emotions, opinions, or relationships, you are not interacting with a real human being.
Responses generated by WallBreaker are produced by artificial intelligence and may be inaccurate, incomplete, inconsistent, or inappropriate. AI Characters should not be treated as real people and should not be relied upon for medical, mental health, legal, financial, or other professional advice.
If you need professional or emergency assistance, you should contact an appropriately qualified professional or emergency service rather than relying on WallBreaker.
2. Eligibility
You must be 18 years old or older to access or use WallBreaker.
By using the Service, you represent and warrant that:
You are at least 18 years old.
You have the legal capacity to enter into these Terms.
The information you provide to WallBreaker is accurate and current.
You will comply with these Terms and all applicable laws and regulations.
If we reasonably believe that an account is being used by someone under the age of 18, we may suspend or terminate that account.
WallBreaker may implement additional age-verification measures where appropriate.
3. Acceptance of These Terms and Changes
These Terms and our Privacy Policy govern your use of the Service.
By creating an account, accessing the Service, or using any WallBreaker feature, you acknowledge that you have read, understood, and agreed to these Terms and the Privacy Policy.
We may modify these Terms from time to time. Updated Terms will be posted on the Service with a revised "Last Updated" date.
If you do not agree to any updated Terms, you must stop using the Service.
Your continued use of the Service after updated Terms become effective constitutes your acceptance of the revised Terms, to the extent permitted by applicable law.
We may also modify, update, suspend, restrict, or discontinue any part of the Service, including features, Characters, functionality, or content, at any time.
4. Your Account
Certain features of WallBreaker require you to create an account.
When creating an account, you agree to:
Provide accurate and current information.
Keep your account information up to date.
Maintain the security of your account credentials.
Keep your verification information confidential.
Be responsible for activity occurring through your account.
You must not allow another person to use your account or use another person's account without authorization.

5. Use of the Service
WallBreaker is provided for your personal, non-commercial use unless we expressly authorize otherwise.
You may use the Service to:
Create and customize AI Characters.
Discover and interact with Characters.
Participate in AI-powered conversations.
Generate or interact with AI-generated content.
Use available voice features.
Use other features made available by WallBreaker.
You agree to use the Service only in accordance with these Terms and applicable laws.
You must not use the Service in a manner that interferes with or disrupts the Service or its operation.
6. User Responsibilities
You are responsible for the information, text, images, audio, Character configurations, messages, and other materials that you submit, upload, generate, or otherwise provide through the Service ("User Content").
You represent and warrant that:
You have the necessary rights and permissions to submit your User Content.
Your User Content does not unlawfully infringe the rights of another person.
Your use of User Content through WallBreaker complies with applicable laws.
You will not knowingly provide content that you are prohibited from sharing or using.
You will not use the Service to plan, facilitate, or carry out unlawful activities.
You are responsible for your use of the Service and for the consequences of the content and instructions you provide to WallBreaker.
7. Character Creation and Public Characters
WallBreaker may allow you to create your own Characters and choose whether to make them Public or Private.
A Character may include information such as:
Character name.
Character image.
Gender.
Tags.
Character description.
Character settings.
Greetings.
Example dialogues.
Voice settings.
Other information or content associated with the Character.
If you choose to make a Character Public, information associated with that Character may be displayed through WallBreaker's discovery or other public-facing features, and other users may be able to interact with the Character.
You should not include confidential, private, or sensitive information in a Public Character unless you have the right to make that information publicly available.
If you choose to keep a Character Private, the Character is intended to remain accessible through the private features associated with your account.
However, you understand that no online service can guarantee absolute security or uninterrupted availability.
8. Voice and Voice Cloning
WallBreaker may provide voice selection, voice recording, or voice-cloning features.
If you upload, record, or otherwise provide a voice sample, you represent and warrant that you have the necessary rights and permissions to use and provide that voice sample through the Service.
You must not use WallBreaker to:
Clone or imitate another person's voice without appropriate authorization.
Impersonate another person.
Mislead others about the identity of a real person.
Create fraudulent or deceptive content using another person's voice.
Use voice cloning in violation of applicable law or third-party rights.
We may restrict, remove, or disable voice content or voice-cloning features when we reasonably believe that such use violates these Terms, applicable law, or the rights of another person.
9. AI-Generated Content
WallBreaker may generate text, images, voices, Character content, and other materials through artificial intelligence ("AI Output").
AI Output may be inaccurate, incomplete, unexpected, offensive, or otherwise unsuitable for your intended purpose.
You are responsible for evaluating AI Output before relying on, sharing, publishing, or otherwise using it.
You should not assume that information provided by an AI Character is accurate or represents the views of WallBreaker.
AI Output does not constitute professional advice.
WallBreaker does not guarantee that AI Output will be accurate, unique, appropriate, or suitable for any particular purpose.
10. Prohibited Uses
You must use the Service only for lawful and authorized purposes.
You must not:
Use the Service if you are under 18 years old.
Use automated systems, bots, scripts, or other unauthorized methods to access or interact with the Service.
Create multiple accounts for the purpose of circumventing restrictions or abusing the Service.
Scrape, crawl, harvest, extract, or systematically collect information from the Service without our express permission.
Attempt to gain unauthorized access to the Service, another user's account, or related systems.
Circumvent or interfere with security features, access controls, usage restrictions, or other technical safeguards.
Introduce viruses, malware, malicious code, or other harmful material.
Reverse engineer, decompile, disassemble, or attempt to discover the source code or underlying technology of the Service except where applicable law expressly permits such activity.
Copy, modify, reproduce, redistribute, or create derivative works from the Service without authorization.
Use the Service to develop, train, or improve a competing product or service using WallBreaker's proprietary materials or data.
Impersonate another person or falsely represent your identity or affiliation.
Use the Service to harass, threaten, stalk, intimidate, abuse, or defame another person.
Use the Service to commit fraud, scams, phishing, or other deceptive activities.
Create or distribute content that unlawfully exploits, abuses, or sexualizes minors.
Create or distribute non-consensual sexual or intimate content involving a real person.
Use another person's image, likeness, name, or voice without appropriate authorization where such authorization is required.
Use the Service to facilitate violence, terrorism, serious criminal activity, or other unlawful conduct.
Violate the privacy, intellectual property, publicity, or other rights of another person.
Use the Service in a way that places an unreasonable burden on WallBreaker's systems or infrastructure.
Use the Service for any purpose that violates applicable laws or regulations.
We reserve the right to investigate suspected violations and take appropriate action.
11. Content Moderation and Enforcement
We may use automated systems, human review, or other appropriate methods to monitor, investigate, detect, prevent, or respond to activity that may violate these Terms or applicable law.
Depending on the circumstances, we may:
Remove or restrict User Content.
Change the visibility of a Character.
Disable or restrict a Character.
Restrict particular features.
Suspend or terminate an account.
Restrict access to the Service.
Take other reasonable measures necessary to protect users, the Service, or third parties.
We do not guarantee that all content will be reviewed or that all prohibited content will be detected.
If you believe that content or activity on WallBreaker violates these Terms, you may report it to
12. Ownership and Intellectual Property
WallBreaker and its licensors own or control all rights, title, and interest in and to the Service and its proprietary components, including, as applicable:
Website design and interface.
Software and code.
Branding, logos, and trademarks.
Graphics and other visual materials.
Proprietary technology.
Service functionality.
WallBreaker-created content.
Other intellectual property associated with the Service.
Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, license, lease, publicly display, or otherwise exploit WallBreaker's proprietary materials.
Nothing in these Terms grants you ownership of WallBreaker's intellectual property.
13. Your User Content and License to WallBreaker
You retain ownership of User Content to the extent that you own the applicable rights.
By submitting User Content to WallBreaker, you grant WallBreaker a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, display, and modify your User Content as reasonably necessary to operate, maintain, provide, secure, and improve the Service and its features.
This license does not transfer ownership of your User Content to WallBreaker.
For Public Characters, you understand that WallBreaker may make the Character and associated information available to other users through features designed to display or discover Public Characters.
You are responsible for ensuring that you have the necessary rights to grant the permissions described in this section.
14. AI Service Providers and Third-Party Services
WallBreaker may rely on third-party technologies, service providers, AI models, hosting providers, voice technologies, image-generation technologies, analytics services, or other third-party services to operate certain features.
The availability and functionality of certain WallBreaker features may depend on these third-party services.
The Service may also contain links to third-party websites or services.
Third-party services are generally subject to their own terms and privacy policies.
WallBreaker is not responsible for third-party services that it does not control.
15. Data and Privacy
Your use of personal information through WallBreaker is also governed by our Privacy Policy.
You should review our Privacy Policy to understand how WallBreaker collects, uses, stores, and otherwise processes personal information.
You should not submit personal information belonging to another person unless you have the right and necessary authorization to do so.
You are responsible for ensuring that information you provide to WallBreaker may lawfully be processed for the purposes for which you provide it.
16. Feedback and Suggestions
You may provide WallBreaker with comments, suggestions, ideas, feedback, or other information about the Service ("Feedback").
You agree that WallBreaker may use Feedback for purposes including improving, developing, and operating the Service without compensation or obligation to you, provided that such use does not disclose your personal information in violation of our Privacy Policy.
17. Service Availability and Modifications
WallBreaker may modify, update, suspend, or discontinue the Service or any part of it at any time.
We may add, remove, modify, or limit features, Characters, models, functionality, or other aspects of the Service.
We do not guarantee that the Service or any particular feature will always be available.
The Service may be unavailable or interrupted because of maintenance, technical problems, security incidents, third-party service failures, or circumstances beyond our reasonable control.
18. Account Suspension and Termination
You may stop using WallBreaker at any time.
We may suspend or terminate your account or access to the Service if:
You violate these Terms.
You violate our Privacy Policy or other applicable policies.
You engage in unlawful, fraudulent, abusive, or harmful activity.
Your activity creates a security or operational risk.
We are required to do so by law.
We discontinue the Service or the relevant feature.
When an account is terminated or deleted, access to associated Characters, conversations, User Content, or other account information may be restricted or removed, subject to our Privacy Policy and applicable law.
We may retain certain information where required by law or where reasonably necessary for legitimate business, security, fraud prevention, dispute resolution, or other lawful purposes.
Sections that by their nature should survive termination will continue to apply after termination, including provisions relating to intellectual property, User Content, disclaimers, limitation of liability, indemnification, and dispute-related provisions.
19. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ALL AI OUTPUT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
WALLBREAKER DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY, EXCEPT TO THE EXTENT THAT SUCH WARRANTIES CANNOT BE DISCLAIMED UNDER APPLICABLE LAW.
WE DO NOT WARRANT THAT:
THE SERVICE WILL ALWAYS BE AVAILABLE OR UNINTERRUPTED;THE SERVICE WILL BE ERROR-FREE OR SECURE;AI OUTPUT WILL BE ACCURATE, COMPLETE, OR RELIABLE;AI CHARACTERS WILL BE CONSISTENT OR RESPOND IN ANY PARTICULAR WAY;ANY PARTICULAR CHARACTER, FEATURE, MODEL, VOICE, IMAGE, OR CONTENT WILL REMAIN AVAILABLE;THE SERVICE WILL MEET YOUR EXPECTATIONS OR REQUIREMENTS; ORTHE SERVICE WILL BE FREE FROM ALL HARMFUL, OFFENSIVE, OR UNDESIRABLE CONTENT.
YOU USE THE SERVICE, USER CONTENT, AND AI OUTPUT AT YOUR OWN RISK.
20. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WALLBREAKER, SUMERUAI LLC, AND THEIR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE.
THIS INCLUDES, TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL LIABILITY OF WALLBREAKER AND SUMERUAI LLC ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED US$100.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
21. Indemnification
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless WallBreaker, SUMERUAI LLC, and their affiliates, officers, directors, employees, contractors, agents, licensors, and service providers from and against claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:
Your violation of these Terms.
Your User Content.
Your misuse of the Service.
Your violation of applicable law.
Your violation of the rights of another person.
Your unauthorized use of a person's name, image, likeness, or voice.
Your use of the Service in a manner not permitted by these Terms.
Your obligations under this section survive termination of your account or use of the Service.
22. Assignment
WallBreaker may assign or transfer these Terms, in whole or in part, in connection with a merger, acquisition, corporate restructuring, sale of assets, or other business transaction.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent, except where such restriction is prohibited by applicable law.
23. Governing Law
These Terms will be governed by the laws of the State of Washington, without regard to its conflict-of-law principles, except to the extent that applicable law requires otherwise.
Nothing in this section is intended to deprive you of mandatory consumer rights or protections provided by the laws applicable to you.
24. Dispute Resolution
If you have a dispute or concern relating to WallBreaker or these Terms, please first contact us at wallbreakerai@outlook.com and provide us with an opportunity to address the issue informally.
Nothing in this section prevents you from exercising rights or remedies that cannot legally be waived.
Any arbitration agreement, class-action waiver, or other mandatory dispute-resolution procedure will only apply if separately provided in accordance with applicable law.
25. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.
26. Entire Agreement
These Terms and our Privacy Policy constitute the agreement between you and WallBreaker regarding your use of the Service, except where additional terms expressly apply to a particular feature or service.
If any additional terms apply to a particular feature, those terms will apply together with these Terms.
